By placing an order, submitting an enquiry, or purchasing products from Toughcover, you agree to be bound by these Terms & Conditions.
● Products means container shelters, domes, frames, covers, accessories and related components supplied by Toughcover.
● Customer means the person or entity purchasing or enquiring about products.
● Warranty Policy means Toughcover’s published 10-Year Structural Warranty policy.
● All quotations are valid for 30 days unless stated otherwise.
● Orders are confirmed only upon receipt of a deposit or full payment, as agreed at the time of order.
● Toughcover reserves the right to decline or cancel orders where pricing, product availability or information errors occur.
Custom or made-to-order items may require extended lead times and are subject to separate confirmation.
● All prices are quoted in Australian Dollars (AUD) and are exclusive or inclusive of GST as stated.
● Freight, unloading and installation costs are not included unless specifically agreed in writing.
● Toughcover reserves the right to withhold dispatch until full payment is received.
● Standard delivery is kerbside only, unless otherwise agreed.
● Customers are responsible for unloading and ensuring suitable site access.
● Risk passes to the customer upon delivery to the nominated address or upon collection.
● For warehouse pickups, the Customer is responsible for ensuring their vehicle or trailer is legally capable of carrying crate. Toughcover reserves the right to refuse loading if the transport arrangement is deemed unsafe.

● Products must be installed strictly in accordance with Toughcover installation instructions. The AS/NZS 1170.2:2021 engineering certification is only valid if the product is installed strictly according to the provided manual.
● Customers are responsible for confirming site suitability, wind region classification and intended use prior to installation.
● Any unauthorised modification, misuse or improper installation may void warranty coverage.
Warranty coverage is provided separately under Toughcover’s 10-Year Structural Warranty Policy.
● Structural, fabric and pro-rata terms are outlined in that policy.
● Nothing in these Terms & Conditions limits rights available under Australian Consumer Law.
Returns, cancellations and transit issues are governed by our Shipping & Returns Policy.
● Change-of-mind returns may be subject to restocking fees and return freight costs.
● Custom, pre-order or made-to-order products may not be eligible for return.
To the extent permitted by law:
● Toughcover is not liable for any indirect, incidental or consequential loss, including loss of profits, business interruption or downtime.
● Toughcover’s liability is limited to repair, replacement or refund of the product supplied, at our discretion.
Nothing in these Terms excludes or restricts rights or remedies available under Australian Consumer Law.
Toughcover is not liable for delays or failure to perform obligations due to events beyond reasonable control, including but not limited to transport disruptions, supplier delays, industrial action, natural disasters or extreme weather.
Personal information is handled in accordance with our Privacy Policy, including information provided for enquiries, orders and warranty registration.
These Terms & Conditions are governed by the laws of Victoria, Australia, and the parties submit to the exclusive jurisdiction of the courts of Victoria.
